CHRB Considering Dates Adjustment

By DRF.com DEL MAR, Calif. (July 18, 2014)  – Santa Anita may add two days of racing to its autumn meeting, and Los Alamitos may move the date of the richest race of its county fair meeting in September, after discussions at Friday’s California Horse Racing Board meeting. The racing board approved licenses for three meetings – at Los Alamitos from Sept. 5-21, the San Joaquin County Fair at Stockton form Sept. 19-28, and at Santa Anita from Sept. 26 to Nov. 2. Commissioner Madeline Auerbach asked Santa Anita officials to consider adding Thursday, Sept. 25 and Wednesday, Oct. 29. Auerbach argued that turf racing on Sept. 25 would be beneficial for a circuit that will race only on dirt during the Los Angeles County fair meeting at Los Alamitos from Sept. 5-21 following the closure of Del Mar on Sept. 3. Auerbach said that by racing on Oct. 29 Santa Anita could take advantage of additional interest from fans and horsemen on a week when the track hosts the... ...

House Passes Bonus Depreciation

From NTRA WASHINGTON, D.C. (July 11, 2014) — Today the House of Representatives passed H.R. 4718, a bill that amends the Internal Revenue Code to make permanent 50% bonus depreciation for qualified property purchased and placed in service after December 31, 2013.  The House also recently voted to permanently increase the expense allowance to $500,000 (with a $2 million investment threshold), up from the current level of $25,000 ($200,000 threshold). Bonus depreciation expired and the expense allowance dropped at the end of 2013. Bonus depreciation applies only to new business property such as a yearling.  The expense allowance applies to both new and used property.  Examples of used property include broodmares and horses of racing age. The House also is considering the expired three-year depreciation schedule for racehorses but this provision is pending. The Senate will address tax extender legislation for numerous business tax provisions, including those above, that expired or reverted to lower levels at the end of 2013. The NTRA Legislative Team anticipates that these expiring tax provisions... ...

From CHRB SACRAMENTO, Calif. (June 25, 2014) – The California Horse Racing Board (CHRB/Board) adopted regulations June 19 to limit the use of corticosteroids in racing horses and to impose further restrictions on shockwave therapy. The move is part of an aggressive effort by the Board to protect horses and riders. The changes are expected to go into effect in October following final regulatory review. “The people who play by the rules should have the best shot, not the people who don’t play by the rules,” said Board Chairman Chuck Winner. “This is the way it is going to be from now on, and we’re going to work very hard to make sure the integrity of the sport is protected.” The Board voted to set limits on certain medications consistent with the national uniform medication program. The most significant of these limits is for corticosteroids, potent anti-inflammatory medications. When used improperly, corticosteroids could mask serious injury from the examining veterinarians and allow injured horses to compete. The restrictions will fundamentally... ...

Lawmakers Seek Tax Clarification

From NTRA NEW YORK CITY (June 3, 2014) – The National Thoroughbred Racing Association (NTRA) today released a copy of a bipartisan letter from key members of Congress asking the Department of Treasury to clarify regulations regarding the way pari-mutuel winnings are calculated for tax purposes. The NTRA is also calling on horse racing industry participants and customers to express their support of the effort by signing a Change.org petition available here: http://chn.ge/RXZ6DW. The letter to the Secretary of the Department of Treasury was co-authored by Rep. Charles Boustany (R-LA) and Rep. John Yarmuth (D-KY) and co-signed by more than a dozen other congressmen. The request for clarification urges the inclusion of a bettor’s entire investment in a single pari-mutuel pool to determine the amount reported or withheld for tax purposes, as opposed to only the amount wagered on the correct result. This issue typically arises in the context of increasingly popular exotic wagers. For example, under the proposed clarification, the amount wagered by a Pick 6 player who hits... ...

Tax Extender Bill Delayed

From NTRA WASHINGTON, D.C. (May 22, 2014) — Progress on the EXPIRE Act (S. 2260), legislation that would extend expired or expiring tax provisions through 2015, has been delayed until at least next month, according to Senate Finance Committee Chairman Ron Wyden (D-OR). Senator Wyden said earlier this week that he hopes to work with Committee ranking member Sen. Orrin Hatch (R-UT) over the Memorial Day recess to resolve an amendments standoff that has halted progress of the $85 billion bill. Several of the provisions in the EXPIRE Act will directly impact horse owners and breeders. Most notable of these is a provision to extend the three-year recovery period for younger racehorses that expired at the end of 2013. This faster depreciation schedule replaced a seven-year recovery period that does not accurately reflect current-day investment behavior in racehorses. Unless the Act becomes law, the seven-year schedule will be in place for 2014. Additional provisions in the EXPIRE Act that will positively impact investment in qualified property for horse racing and... ...

Del Mar ‘Ship and Win’ Returns

From DMTC DEL MAR, Calif. (May 22, 2014) — “Ship and Win,” Del Mar’s prosperous program that has attracted hundreds of out-of-state racehorses to the seaside oval over the past three summers, is back for another season in 2014 with its lucrative incentives attached once more. The policy – initiated by Del Mar Thoroughbred Club in partnership with Thoroughbred Owners of California in 2011 – currently offers a guaranteed $1,000 check to all starters, as well as a 33 1/3% bonus payment (stakes races excluded) on top of any purse monies won in a first start at Del Mar to owners of horses who last raced outside California. Del Mar’s 75th racing season will begin on Thursday, July 17 and continue through to Wednesday, September 3. In an additional wrinkle to this year’s program given the new racing calendar in Southern California, Del Mar will be offering a special consideration to its sister racetracks Santa Anita and Los Alamitos. As in past years, the auction will be held the first Sunday of the Del Mar meet in front of a large vibrant crowd after the final race on the card. The purpose of the “one-stop shopping” concept of the Paddock Sale is to encourage new racehorse ownership and increase the “Race Ready” horse inventory in California by promoting Del Mar’s Ship and Win Program. Five horses from the first two years became stakes winners subsequent to The Paddock Sale which equals more than 8% of all horses through the sales rings. Senate Works on Tax Bill

From NTRA WASHINGTON, D.C. (May 15, 2014) — Progress on tax extender legislation continued this week when the U.S. Senate voted 96-3 to advance the EXPIRE Act (S. 2260). Last month the Senate Finance Committee considered and passed this legislation to extend expired or expiring tax provisions through 2015, including several that will directly impact the horse racing industry. Of particular interest to horse owners and breeders is a provision in the EXPIRE Act to extend the three-year recovery period for younger racehorses that expired at the end of 2013. This accelerated depreciation schedule replaced an onerous seven-year recovery period which will return in 2014 unless the EXPIRE Act becomes law. The shorter recovery period more accurately reflects current-day investments in racehorses and helps encourage continued investment. Other provisions in the EXPIRE Act that will positively impact horse racing and other businesses include an increase in the expense allowance and bonus depreciation. In the Act, the expense allowance is set at $500,000 with a $2 million threshold for qualified property... ...

Meeting at Golden Gate Fields, CHRB commissioners had the opportunity to question Henwood and Brad McKinzie, Los Alamitos Racing Association vice president, on the proposed relocation of the 11-day LACF meeting to the Orange County facility Sept. 5-21. The discussion was for informational purposes, coming four days after the announcement of the proposed move was made. Action on the date transfer is likely to occur May 22, once a formal application has been submitted for the board’s regular monthly meeting at Santa Anita Park. None of the six commissioners present spoke against the proposal—in fact, some indicated they favored it. But they did ask several probing questions during the two-hour session. In response, Henwood said Fairplex “is not up the level of major league racing” patrons in Southern California... ...

Phyllis Lambert Passes at 67

By Wendy Averill Phyllis Lambert, who passed away from chronic obstructive pulmonary disease on Mar. 27, 2014, was a fixture at California Thoroughbred sales since the late 1960s. But more than being a “fixture,” she changed the way Thoroughbred sales, and hence the industry, employed women. In 1973, she and (CTBA Director) Leigh Ann Howard were hired by Rollin Baugh, of California Thoroughbred Consultants, to create at Hollywood Park anything necessary to conduct probably the most prestigious and most unprecedented Thoroughbred sale ever conducted in California up to that time. Fletcher Jones, of Westerly Stud Farm, had been killed in an airplane crash and all of his 140 horses were to be dispersed. As Auction Sales Manger, Phyllis and her colleague, Leigh, were responsible for everything horse related for the Westerly Dispersal. The sale barns they were to use at Hollywood Park were a mud bog so truckloads of rock dust had to be dropped and leveled. Stall screens had to be borrowed, sand blasted, painted in Rollins’ colors and,... ...

Statement from Vessels Stallion Farm

“The Vessels Ranch property has been listed for sale with Sotheby’s International Realty in association with Equestrian Real Estate.  The property consists of 1,390 acres and includes the approximately 275 acres on which the Vessels Stallion Farm operation is sited. The Vessels Ranch property is extremely valuable due to its overall size and location within ten miles of the Pacific Ocean in the county of San Diego, California.  The upland portions of the property above the horse facilities have excellent residential development potential.  It has been determined that it is in the best interests of the family to seek to realize the value of this property now rather than continuing to hold it for investment. This news does not mean the end of Vessels Stallion Farm.  We remain open for business and presently have over 260 horses boarded at the Farm.  It would not be unusual for a property of this magnitude to take an extended period of time to sell.  Moreover, any sale transaction will have to allow several... ...

Racing Exempt in Wagering Bill

By Bloodhorse.com WASHINGTON, D.C. (Apr. 11, 2014) — Legislation has been introduced in Congress to amend the 1961 Federal Wire Act to ban all forms of interstate wagering except horse racing. The bill, named the Restoration of America’s Wire Act  (H.R. 4301), was introduced by Congressman Jason Chaffetz (R-UT) and Senator Lindsay Graham (R-SC) (S. 2159). The legislation would amend the Federal Wire Act, the 1961 federal law that prohibits interstate wagering, to prohibit interstate Internet gaming. The bill is a response to the Department of Justice’s change in its previous interpretation of what the Wire Act prohibits, according to a memorandum from the American Horse Council. Since 1961, the DOJ had maintained that the Wire Act banned the interstate transmission of all bets or wagers or information assisting in the placing of bets or wagers. In December 2011, the department issued a ruling that the Wire Act applied only to sports betting, not all wagering, the AHC said. “That ruling effectively broadened what gambling could be offered to include... ...

Tax Depreciation Bill Advances

From NTRA WASHINGTON, D.C. (Thursday, April 3, 2014) – The United States Senate Finance Committee approved today legislation that would extend expired or expiring tax provisions for race horses, including a provision to extend the three-year recovery period. This provision – originally passed by Congress and enacted into law in 2008 – accelerates, simplifies and makes uniform the depreciation period for race horses.  The provision expired at the end of 2013 along with several other tax provisions. The proposed version of the provision that moved out of committee today more accurately reflects current-day investments in race horses and helps to spur continued investments in the racing industry. “I applaud the Committee for moving this bill and for including this important provision in the legislation,” said Alex Waldrop, NTRA President and CEO. “I especially appreciate that the Committee understands the continued importance of our industry and the contribution of the equine economy to job creation and added investment.” The three-year recovery provision was a top priority for the National Thoroughbred Racing... ...

New Immigration Bill Introduced

From NTRA WASHINGTON, D.C. (Mar. 20, 2014) — Congressman Andy Harris (R-MD) recently introduced H.R. 4238 to amend the Immigration and Nationality Act that provides requirements for employers of H-2B nonimmigrant workers and is the basic body of immigration law. Rep. Harris’ bill includes, among its provisions, an amendment that covers returning workers and how they impact the annual cap on the number of H-2B visas available to employers. Specifically, H.R. 4238 reinstates the returning worker exemption so that those workers who complied with the terms of previous H-2B visas can return to the U.S. and not count against the cap of 66,000 visas. Of that number, 33,000 are made available for the first half of the fiscal year and 33,000 for the second half. The first half cap already has been reached. The legislation also clarifies the methodology used to determine the prevailing wage rate that H-2B employers must pay and ensures that workers receive compensation that is both fair and reflective of current market conditions. Thoroughbred Placement Study Released

DAVIDSONVILLE, Md. (Jan. 10, 2014) — A report released today by Retired Racehorse Training Project (RRTP) is the first nationwide study of how Thoroughbred ex-racehorses are transitioned into second careers. It is based on a survey conducted in late 2013 titled Exploring the Bridge To Second Careers in which owners of 4,200 ex-racehorses from 47 states and Canada responded to 23 questions. “The public believes that racing owners dump their retiring horses into auctions and that a lucky few get rescued and adopted,” said RRTP president Steuart Pittman. “Our survey tells a different story. Most of these horses were not rescued. They were sold or donated through networks of people both inside and outside of racing who work very hard to transition these animals.” ·         34% percent of these horses were acquired directly from racing owners. ·         31% were acquired from non-racing private owners. ·         13.5% were acquired from non-profit placement or rescue organizations, although that share increased from 11% to 19% over the last ten years. ·         9% were... ...

(Jan. 9, 2014) — The Association of Racing Commissioners International has added a nasal decongestant already banned by the World Anti-Doping Agency and many U.S. sports leagues to its list of prohibited substances, the association announced on Thursday. The RCI added the drug to its list of Class 1, Penalty A substances, which are those substances that have no known therapeutic use in horses and the potential to impact performance. Positives for Class 1 drugs carry the stiffest penalties. Methylhexaenamine has been detected in horses trained by two Standardbred trainers in New Jersey, according to Steve May, an RCI official. The drug has shown up in several human sports as well, including professional baseball. In 2012, Major League Baseball suspended a Toronto Blue Jays pitching... ...
